| Abstract: | في ظل تطور الجريمة ، لم يعد المشرع يكتفي بالتدخل بعد وقوع الضرر بل وسع من دائرة التجريم لتشمل التجريم الوقائي الذي يعد تدخلا استباقيا لحماية المجتمع من الخطر، ويقوم هذا النوع من التجريم على تجريم افعال تحمل في طياتها مخاطر محتملة حتى وان لم تتحقق نتائجها بعد.وقد تجلى هذا التجريم في التشريع الجزائري من خلال تجريم افعال تمس بالسلامة الجسدية للافراد مثل تعريض الغير للخطر وصورها المختلفة كجريمة التخلي عن الأطفال والعاجزين وتعريضهم للخطر. |
| Description: | With the evolution of crim, the legislture is no longer limited to intervention after the harm has occurred. Rather. It has espanded the scope of criminalization. A proactive measure aimed at protecting society from potential dangers. This type of criminalization is based on criminalizing acts that inherently involve potential risks, even if their harmful consequences have not yet materialized. This type of criminalization is evident in Algerian legislation through the criminalization of acts that endanger the physical safety of individuals. Such as endangering others. And exposing others to the risk of contracting the coronavius. It also includes the criminalization of acts related to drug crimes, such as cultivation; trafficking, and possession to protect society from the effects of this scourge. |
