| Résumé: | تناولت الدراسة مجال الصفقات العموميرة في ضوء القانون الجديد رقرم 23 - 12 ، الذي جاء لتحديث وتنظيم آليات إبرام الصفقات بما يتماشى مع مبادئ الحوكمة والشفافية وحسن إدارة المال العام. تم التطرق إلى المبادئ الأساسية التي تحكم هذه الصفقات وأنواعها، وطرق إبرامها، بالإضافة إلى الإجراءات المفصلة لكل طريقة من طرق التعاقد، مع التركيز على ضرورة تفعيل الرقابة واعتماد الوسائل الرقمية لتحسين الكفاءة وتقليل الهدر. كما أظهرت الدراسة أهمية هذا القانون في تعزيز المنافسة العادلة، وتحقيق الشفافية ومكافحة الفساد، مرن خلال وضع إطار قانوني واضح يضبط العلاقة بين الإدارة والمقاولين ويضمن تنفيذ المشاريع العمومية بكفاءة وجودة |
| Description: | The study addressed the field of public procurement in light of the new Law No. 12 - 23, which was enacted to modernize and regulate the mechanisms for awarding contracts in accordance with principles of governance, transparency, and sound management of public funds. It examined the fundamental principles governing such contracts, their types, and methods of awarding them, along with detailed procedures for each contracting method, emphasizing the need to strengthen oversight mechanisms and adopt digital tools to enhance efficiency and reduce waste. The study also highlighted the importance of this law in promoting fair competition, ensuring transparency, and combating corruption by establishing a clear legal framework that regulates the relationship between the administration and contractors, thereby guaranteeing efficient and high-quality implementation of public projects. |
