| Abstract: | تعد الجريمة المنظمة العابرة للحدود من أخطر التحديات الأمنية العالمية، إذ تحولت إلى شبكات معقدة تدار باحترافية، مستغلة الفجوات القانونية والتقنية للتغلغل في المؤسسات الاقتصادية والسياسية، ورغم الجهود الدولية المبذولة، تمثل اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية )اتفاقية باليرمو( والبرتوكولات المكملة لها مرجعية مهمة لتعزيز التعاون الدولي، من خلال تجريم الأنشطة الإجرامية العابرة للحدود، وتيسير تبادل المعلومات والتنسيق القض ائي والأمني. على المستوى الوطني، تسعى الجزائر لمواءمة التشريعات الوطنية مع المعايير الدولية، عبر تطوير آليات إجرائية تشمل توسيع نطاق الاختصاص القضائي واعتماد أساليب تحر استثنائية، مع الحرص على تحقيق التوازن بين مكافحة الجريمة واحترام حقوق الأفراد، ورغم هذه الجهود، لا تزال التحديات قائمة ؛ بما في ذلك مواكبة التطور الإجرامي والتقني، مما يتطلب تعزيز التعاون الدولي وتطوير أدوات قانونية مبتكرة. |
| Description: | Transnational organized crime is one of the most serious challenges to global security, as it has evolved into complex, professionally managed networks, exploiting legal and technical loopholes to infiltrate economic and political institutions. Despite international efforts, the United Nations Convention against Transnational Organized Crime (Palermo) The Convention and its supplementary protocols are an important reference for strengthening international cooperation, by criminalizing cross-border criminal activities. Facilitating the exchange of information and judicial and security coordination . At national level, Algeria is striving to harmonize national legislation with international standards, by developing procedural mechanisms that include broadening the scope of judicial jurisdiction and adopting exceptional methods, while ensuring a balance between the fight against crime and respect for individual rights. Despite these efforts, a number of challenges remain, notably the need to keep pace with developments in crime and technology, which calls for closer international cooperation and the development of innovative legal tools . |
