| Résumé: | يتبين أن نظام الرخص الإدارية المطبق على نشاط الجمعيات الأجنبية في الجزائر يمعد آلية قانونية ضرورية لتنظيم هذا النشاط، بما يحقق التوازن بين حماية السيادة الوطنية وضمان الانسجام مع متطلبات المصلحة العامة، فالد ولة، من خلال هذا النظام، تسعى إلى ضبط ومتابعة تدخل الجمعيات الأجنبية داخل التراب الوطني، بهدف تفادي أي تجاوزات قد تمس الأمن أو النظام العام، وفي الوقت نفسه، تنظيم العمل المدني بما يساهم في التنمية المجتمعية . ورغم أهمية هذا التنظيم، إلا أن فاعليته تظل مرهونة بمدى وضوح الإجراءات القانونية، وشفافيتها، وانسجامها مع المبادئ الدستورية، وعلى رأسها حرية تكوين الجمعيات والانخراط في العمل المدني. ومن هذا المنطلق، فإن تحقيق التوازن بين متطلبات السيادة ومبادئ الانفتاح والتعاون الدولي لا يمكن أن يتم إلا من خلال مراجعة د ورية للنصوص القانونية ذات الصلة، وتطوير آليات التنفيذ الإداري بما يضمن عدالة التطبيق ويشجع الجمعيات الأجنبية الجادة على الانخراط في العمل المشترك بطريقة قانونية ومنظمة . إن اعتماد مقاربة قانونية متوازنة تراعي المصالح الوطنية دون أن تمقصي فرص التعاون الدولي من شأنه أن يعزز صورة الجزائر كدولة منفتحة على العالم، حريصة على تنظيم العمل الجمعوي الأجنبي دون المساس بثوابتها السيادية . |
| Description: | It is evident that the system of administrative licensing applied to the activities of foreign associations in Algeria constitutes a necessary legal mechanism for regulating such activities. This system aims to strike a balance between protecting national sovereignty and ensuring alignment with the requirements of the public interest. Through this mechanism, the state seeks to monitor and control the involvement of foreign associations within its territory, with the objective of preventing any transgressions that may threaten security or public order, while at the same time organizing civil society work in a way that contributes to community development. Despite the importance of this regulatory framework, its effectiveness remains dependent on the clarity, transparency, and constitutional consistency of the legal procedures—particularly with regard to the freedom of association and participation in civil activities. From this perspective, achieving a balance between the imperatives of sovereignty and the principles of openness and international cooperation requires the periodic review of relevant legal texts and the development of administrative mechanisms that ensure fair implementation and encourage serious foreign associations to engage in joint efforts in a lawful and organized manner. Adopting a balanced legal approach that safeguards national interests without excluding opportunities for international collaboration could enhance Algeria's image as a country open to the world—one that is committed to regulating foreign civil society activities without compromising its sovereign principles. |
