dc.description	In light of the rapid expansion currently witnessed in global trade in goods and services, this study seeks to elucidate the effective role that the statute of limitations in commercial transactions can play. It is grounded in fundamental social considerations and imperatives that aim to establish a notional time limit for the exercise of rights and the initiation of legal actions. The absence of such a framework would inevitably lead to disorder and instability, thereby disrupting financial transactions, as merchants would continue to dispute debts that have long since become outdated. Such a situation stands in clear contradiction to the essential principles upon which commerce is founded — namely, speed and credit. From this perspective, the present study examines the statute of limitations in commercial transactions as a distinct legal system, one that embodies the dynamic interaction between the realms of economics and law, within what may aptly be described as the architecture of the commercial prescription regime.	en_US
dc.description.abstract	تسعى هذه الدراسة في ظل ما يشهده العالم اليوم من توسع متسارع في تجارة السلع والخدمات، الى بيان الدور الفعال الذي يمكن أن ينهض به نظام التقادم في المعاملات التجارية، انطلاقا من الإعتبارات والضرورات الإجتماعية العليا التي تهدف إلى إرساء حد زمني افتراضي لممارسة الحقوق ولرفع الدعاوى. إذ إن غياب مثل هذا التنظيم من شأنه أن يفضي إلى الفوضى وعدم الإستقرار ، وهو مايؤدي الى اضطراب المعاملات المالية، حيث يظل التجار يتنازعون حول ديون مضت عليها فترات طويلة، الأمر الذي يتعارض مع المبادئ الأساسية التي تقوم عليها التجارة، والمتمثلة في السرعة والإئتمان.ومن هذا المنطلق ، تتناول هذه الدراسة نظام التقادم في المعاملات التجارية بوصفه نظاما قانونيا فريدا، يجسد التفاعل الحيوي بين عالمي الإقتصاد والقانون، في إطار ما يمكن تسميته بهندسة نظام التقادم التجاري.	en_US
