Résumé: ما لا يمكن إنكاره أن كلا من الغش والصورية تصرفات لايمكن بأي حال من الأحوال اعتبارهما تصرفات حديثة، وإنما هما من بين التصرفات القديمة قدم الإنسان درج الناس عليهما منذ القدم في معاملاتهم خاصة المالية منها . ولكن كل فعل منهما تصبح له خصوصية خاصة به تميزه عن نظيره المعروف في ظل العقود الماليةن وذلك كلما اقترن الفعلان بعقد زواج دولي لسباب عدة من بينها، الخصوصية القانونية.
Description: What cannot be denied is that both fraud and sham are behaviors that cannot, in any way, be considered modern; rather, they are among the ancient practices that people have engaged in since time immemorial, especially in financial transactions. However, each act acquires its own distinct characteristics that differentiate it from the known counterparts within the context of financial contracts, especially when the acts are associated with an international marriage contract for several reasons, including the legal peculiarities that govern this type of contract due to the risks that a national faces when entering into a marriage contract with a foreigner, and the benefits that accrue to this foreigner on one hand. On the other hand, each of these acts has multiple and varied forms that have always posed legal challenges requiring resolution . Considering fraud in the context of international marriage contracts as an act involving deception coupled with bad faith, it can be directed towards the legal text, as well as towards the other party in this contractual relationship. As for sham marriages, they are merely formal acts that do not exist in reality, with the sole aim of obtaining residency documents and citizenship of the targeted country. These actions have become a real threat that necessitates confrontation and combat. This is what both global legislations and legal doctrine have strived for by creating effective legal mechanisms of a preventive and punitive nature that always work to combat these two phenomena.
