dc.description	The actual company is the company that carries on its activity despite the failure of one of its components, and others deal with it as a valid company. The theory of the actual commercial company is a theory of judicial origin, as the French judiciary invented it as a legal technique to protect third parties in good faith dealing with it. The company, and studies have shown that the Algerian legislator is influenced by the French legislator, which recognized the theory of the actual commercial company for its theoretical and practical benefits. However, the Algerian judiciary is still hesitant about this theory despite its entrenchment in most comparative legislation. The Algerian legislator did not assign the actual company to a specific legal organization, as is the case. In French legislation, which explicitly addresses this company in legal texts	en_US
dc.description.abstract	الشركة الفعلية هي الشركة التي تباشر نشاطها رغم إختلال أحد أركانها، ويتعامل الغير معها على إعتبارها شركة صحيحة، ونظرية الشركة التجارية الفعلية نظرية قضائية المنشأ، حيث إبتكرها القضاء الفرنسي كتقنية قانونية لحماية الغير حسن النية المتعامل مع الشركة، وبينت الدراسات أن المشرع الجزئري متأثر بالمشرع الفرنسي الذي اِعترف بنظرية الشركة التجارية الفعلية لفوائدها النظرية والعملية، غير أن القضاء الجزائري لا يزال متردد إزاء هذه النظرية بالرغم من رسوخها في أغلب التشريعات المقارنة، فلم يخص المشرع الجزائري الشركة الفعلية بتنظيم قانوني معين كما هو الحال في التشريع الفرنسي الذي تعرض لهذه الشركة بصورة صريحة في نصوص قانونية.	en_US
