For this reason, we followed the descriptive analytical approach. By treating the concept of informal economy and its approaches in Algeria, and on the other hand, this study pointed to indicators of measurement of the informal economy, and this study also focused on ways to reduce the informal economy. The study concluded that the high level of the informal economy in the Algerian economy is mainly linked to institutional reasons, which at the same time explains the weak performance of this economy. Auteur(s): بن أحمد, محمد Résumé: تهدف هذه الورقة البحثية إلى تسليط الضوء على المكافحة الجزائية للتجارة غير المشروعة و حماية المستهلك في التشريع الجزائري وذلك بعد انتهاج الدولة لنظام الاقتصاد الحر وما نتج عنه من ظهور ممارسات تجارية غير نزيهة اعتمدها التجار والأعوان الاقتصاديين من أجل جلب أكبر عدد من المستهلكين. و من أجل ذلك قمنا بإتباع المنهج الوصفي التحليلي، وذلك من خلال استعراض الإطار المفاهيمي لجرائم الممارسات التجارية غير المشروعة، و من جهة أخرى تطرقت هذه الدراسة إلى ضبط ومعاينة المخالفات الناجمة عن الممارسات التجارية غير المشروعة وفق أحكام القانون 04/02 المتعلق بالقواعد المطبقة على الممارسات التجارية، وكذا قانون العقوبات والقوانين المكملة له، دون أن ننسى دور قانون الإجراءات الجزائية في مجال المتابعة والمحاكمة. و توصلت هذه الدراسة إلى أن المشرع الجزائري لم يحدد بشكل واضح وصريح ودقيق صور الممارسات التجارية غير المشروعة و التي تمس مباشرة بحقوق المستهلكين وإنما اكتفى بالإشارة إليها بصفة عرضية دون تفصيل، وخلصت الدراسة إلى جملة من النتائج و التوصيات المقترحة Description: This study aims to identify the criminal control of illegal trade and consumer protection in Algerian law after the adoption of the state of the economy which led to the apparition of trickedbusiness practices adopted by traders and economic agents to attract the largest number of consumers. For this reason, we have followed the descriptive analytical approach, for this we have started with the conceptual framework of illegal business practices, this study also addressed the control and inspection of violations resulting from illegal business practices, in accordance with the provisions of law 04/02 on the rules applicable to business practices. The study concluded that theAlgrian legislator did not specify, frankly and accurately, the dimensions of illegal business practices directly affecting consumers' rights, but simply referred them by chance and without explanation. For this reason, we followed the descriptive analytical approach. For that we started with the conceptual framework of the electronic management and the commercial register, and on the other aspect, this study evoked the tax evasion as inevitable consequence of the absence of commercial register, and this study also focused on the digitization of the commercial register and its importance for traders and on the transparency of control. The study concluded that the electronic commercial registry is a very effective tool for reducing tax fraud. The study ended with a set of conclusions and recommendations. For this reason the researcher used descriptive approach based on collection and analysis what the researchers wrote about the subject of books, research and studies to build the theoretical background of the study, we followed also the descriptive analytical approach, For this we started with the conceptual framework of informal trade and organized commercial spaces, this study also addressed how to absorb informal trade and redistribute its practitioners in organized commercial spaces, as well as the chaotic situation of the Berahal market in Annaba. The study concluded that this policy includes imbalances in the long-term application, especially if there is no close coordination between the agencies involved and if there has been no periodic monitoring of the spaces commercial.
